SMITHFIELD SCITUATE FOSTER GLOCESTER | VALLEY BREEZE & OBSERVER | NOVEMBER 7-13, 2019 SCITUATE 5 Board of Canvassers sends D'Agostino complaint to AG He's a qualified voter, but testimony raises questions SCITUATE – Months of public hearings on the town moderator's qualifications to hold office culminated in the Board of Canvassers sending a letter to the Office of the Attorney General last month. The letter, signed by the Board of Canvassers Chairwoman Judith Weidenbacher Oct. 28, outlines the original complaint against David D'Agostino Jr.'s eligibility to hold office. Weidenbacher declined to comment this week, saying the letter is self- explanatory. In summary, though the Board of Canvassers found D'Agostino lived in Scituate when he declared his candida- cy, it also deemed his testimony to be contradictory. Because the board does not have the jurisdiction to pursue or enforce perjury allegations, members decided to send the AG the transcript for review. The complaint stems from D'Agostino's voter registration form filed under a false address of 9 Neil Lane. Former Town Councilor John Mahoney filed the complaint with the Board of Canvassers a year ago and said D'Agostino could not run for office as town moderator due to an invalid voter registration form. During the public hearings, D'Agostino attempted to legitimize his residency at 9 Neil Lane with his mailing address, which was used for voter registration, vehicle registration, driver's license, car insurance, credit cards, and more, the letter reads. The letter states that D'Agostino said he lived at 9 Neil Lane from 2008 to 2018, but slept there "less than one percent of the time," and there was not a bed at the home since 2008. "The timeline showing exactly how Mr. D'Agostino's address was estab- lished is not completely clear, but it appears that he was able to establish residency with the DMV through phone and cable bills for services that he established at that address," it states. In the letter, the Board of Canvassers said D'Agostino changed his address to 3 Waterman Drive on Oct. 16, 2018, where he had been liv- ing since 2008. The board ruled D'Agostino was eli- gible to vote in Scituate based on his residency at 3 Waterman Drive.
